Who pays the mortgage when one spouse moves out?
For the matrimonial home both parties generally remain responsible for joint financial obligations until the divorce is finalised. The aim is to maintain the financial status quo, and avoid any arrears until a formal agreement is reached.
It may sometimes be possible to ask for a payment holiday from the mortgage provider, especially if the property is on the market for sale.
Alternatively, if one party needs to pay rent when they move out, the other party could recoup any mortgage payments made on behalf of the other, once the property is sold.
