Who owns a dog in divorce?
Under English law, dogs are considered “chattels,” similar to furniture. Accordingly, a court will view a dog as property. No special consideration is given for the emotional bonds between owners and pets in divorce proceedings, unlike children in divorce.
If there is a dispute about ownership of a dog, a court will consider the following evidence in making a ruling about ownership:
Who purchased the dog. The strongest evidence of ownership is typically a receipt or other proof of purchase.
Whose name is on the microchip and/or kennel club registration.
Who pays for the pet insurance and vet bills.
While not a legal determinant, who has been the dog’s primary carer.
