What are the section 25 factors?
The factors refer to criteria set out in the Matrimonial Causes Act 1973 which courts in England and Wales must consider when making financial orders on divorce or dissolution. These common-sense factors guide the court in determining a fair distribution of assets and income, and apply whether the case goes to court or is settled through negotiation.
Factors include earning capacity, financial needs, the ages and health of the parties, contributions made, and the length of the relationship.
The goal is to achieve a fair outcome that meets the needs of both parties and any children, taking into account both past contributions, standard of living and future needs.
