At what stage can you stop a divorce?

You can stop a divorce at any point before the Final Order is issued by the court. In the divorce process there are 2 pockets of time that are designed to give the parties time to reflect on the divorce.

The first pocket of time is the 20-week cooling off period where it is possible to stop the divorce and stay married.

The second pocket of time is the waiting period of 43 days after the date of the Conditional Order before you can apply for the Final Order. In this period, you can also stop the divorce.

Dating during divorce.

Since the introduction of no-fault divorce, adultery is no longer relevant when a marriage has already irretrievably broken down.  Unless there is a possibility of reconciliation, there is no reason why you should not begin dating during divorce.

You should however be aware of some practical considerations. 

If you decide to cohabit with a new partner or plan to do so in the near future – you have a duty to disclose this information in any financial proceedings relating to the divorce.

If you have a child or children from your marriage, it is crucial to consider when you will introduce a new partner to your children, and how it might impact their adjustment to the divorce.

What counts as harassment post divorce?

Harassment post divorce refers to a range of harmful behaviours by an ex-spouse to control, intimidate or distress the other after the end of their marriage. Forms of harassment can include:

Excessive communication where the ex may bombard their former spouse with numerous emails, phone calls, and messages that are abusive in nature.

They might also stalk or monitor their ex using social media, online communication tools, or spyware.

The abuser may intentionally misuse legal proceedings to harass, intimidate, and exhaust the financial and emotional resources of their ex spouse. This can involve making false allegations, making multiple court applications, breaching court orders, or not cooperating with coparenting.

Another tactic is to withhold or delay financial support, such as child support, spousal maintenance, or refusing to pay shared expenses like school fees.

How does a clean break order work?

A clean break order is an agreed financial settlement that cuts all financial ties between a divorcing couple. Once approved by a Judge, it ends all financial obligations between a couple, and prevents any future claims against each other’s income, property, pensions or assets like inheritances.

A clean break order guarantees financial independence and certainty post-divorce.

Why do I have to complete a D81 form in divorce?

The purpose of the D81 form is to allow the court to assess whether the proposed financial agreement contained in a consent order is fair. The D81 form provides a summary of both parties’ financial positions, and explains the impact of the proposed consent order.

A court is not able to consider a proposed Consent order without a completed D81 form from both parties.

Are Separation Agreements legally binding?

Separation agreements are private contracts between separating couples, enforceable through contract law.

Courts generally uphold Separation agreements if they have been properly and fairly negotiated, the agreement is fair, both parties have been candid about their financial situation, and received independent legal advice before the agreement was signed.

What are Relationship Agreements?

Relationship agreements are legal documents that outline the rights, responsibilities, and financial arrangements between couples who are living together, planning to do so, or separating.

There are various types of relationship agreements including Cohabitation, Prenuptial, Postnuptial and Separation agreements.

Relationship agreements can provide couples with clarity and certainty, and are useful for protecting assets, inheritances, and financial contributions.

Do you change your name in a civil partnership?

There is no legal requirement to change your name when entering into a civil partnership.

Here are the main options for changing your name if you wish to do so.

Keep your original name.

Adopt your partner’s surname.

Create a double-barrelled surname using both your surnames.

Choose an entirely new surname for both partners.

What is the No Order principle in family law?

The best practice during a divorce is to stop or significantly reduce social media activities until after the divorce is settled.

You should always assume that everything that is posted by you, can and will be seen by your ex-spouse and their lawyer. If use of social media is absolutely necessary, carefully consider how posts or photos could be interpreted or use as evidence before posting.
