It allows couples to address changes in their financial situation during marriage, such as ownership of a business, or receiving an inheritance. A postnup can be important for people entering a second marriage. An agreement allows couples to make it clear how their finances should be divided in the event of a divorce. Courts generally view postnuptial agreements with more scrutiny compared to prenuptial agreements, but they can still be upheld if certain conditions are met. The conditions are:
The agreement must be voluntary.
There was full financial disclosure.
It was signed a reasonable time after marriage.
