How serious is a breach of undertaking?
An undertaking is a legally binding promise given by a person to the Court, to do or not do something. A breach of undertaking in the Family Court is treated the same as if it was a breach of a court order.
If an undertaking is breached, the other party can apply to the court for enforcement. If a breach is found, this can result in contempt of court proceedings which can be punishable by a fine, or imprisonment for up to 2 years.
