Does judicial separation end a marriage?
Judicial separation, also known as legal separation does not legally end a marriage as with divorce. It formally ends a couple’s obligation to live together, but they remain legally married after obtaining a judicial separation.
It also allows a court to make orders regarding finances and property similar to divorce proceedings. A court can make most of the same financial orders, except for pension sharing or clean break orders.
Some couples choose judicial separation over the finality of divorce for personal, cultural and religious reasons. Judicial separation leaves open the option of reconciliation.
A couple who are judicially separated can also pursue a divorce at a later date, if they wish.
