Do prenuptial agreements hold up in the UK courts?

Prenuptial agreements are not legally binding in the UK, but they are increasingly recognised and enforced by courts as long as certain criteria are met. The criteria include both parties receiving independent legal advice, full financial disclosure, and not being placed under duress or undue influence. The terms of the agreement should also be fair and not unfairly disadvantage one party. In a 2023 case the court upheld a prenuptial agreement that provided for each party to retain any assets they accumulated before they met.
