Can my spouse evict me if our home is in their sole name?

Your spouse or civil partner is not legally allowed to evict or exclude you from your shared home without a court order, such as an Occupation order.

As long as you are married or in a civil partnership, you have a right to live in the family home even if you are not the legal owner of the property.

If you are evicted, or prevented entry into your home (without a court order), you should immediately contact the Police. You should also obtain an Occupation Order to re-enter and occupy the property.
