Am I liable for my husband’s debts?
Generally, a debt remains the responsibility of the person who took it out. This means that one spouse or civil partner cannot be held legally liable for debts incurred solely by the other. This applies to debts such as credit cards, loans, store cards and overdrafts.
Debts incurred for family expenses, or for the benefit of the family during the marriage may, however, be considered joint liabilities in some cases.
During divorce proceedings, a court may consider these debts as shared responsibilities, even if they’re in one spouse’s name.
