What is an Order for sale?
An Order for Sale in divorce proceedings is where the court orders the sale of a jointly owned asset, such as the family home. The Order is typically made when the parties are unable to agree on the terms of sale, or the sale of the property themselves.
Once an Order for Sale is made, the court will give directions such as the timeline for the property to be sold, and specify how the net proceeds of sale will be divided between the parties.
