Can I withdraw half the funds from a joint account during a divorce?
In a joint account, both parties each have an equal right to the funds in the account. This extends to ALL the funds in an account. If you think it is likely that your spouse may withdraw ALL the funds held in a joint bank account, you may wish to withdraw your HALF share. You should then place half the funds into an account in your sole name pending the outcome of the divorce.
