Can I challenge a CAFCASS report?
The first step in challenging a report should be to contact CAFCASS in writing and clearly explain which aspects of the report you disagree with and why, and request them to amend the report.
If this is unsuccessful, the following additional options exist to challenge a report within the court process.
Request permission to instruct an independent expert such as a child psychologist or independent social worker to provide an alternative assessment of the case.
File a detailed Statement addressing the points you disagree with in the report by including any supporting evidence that contradicts the findings or recommendations.
Ask for an addendum report to address issues not covered in the original report, or any challenged or inconsistent points. It will be necessary to explain to the court why an addendum is necessary.
Request that the CAFCASS officer attend the final hearing so your legal representatives can cross-examine the officer about their enquiries and recommendations.
