The main differences between divorce and Judicial separation are as follows:
Judicial separation removes the legal obligation to live together, whereas a divorce ends the marriage completely.
Once your marriage has ended by divorce you are free to remarry. However, with Judicial Separation you remain married and cannot marry another person.
To end your marriage, you must wait for at least one year before commencing proceedings for divorce. With Judicial Separation you can apply at any time after the marriage.
A Court can make a Pension Sharing Order as part of the financial proceedings related to divorce, but they cannot exercise the same power for Judicial Separation.
