How to apply for divorce in 5 steps

Eligibility – To be eligible, you must have been married for at least 12 months and your marriage must be legally recognised in England and Wales.

Sole or Joint application? – A sole application is if you are applying alone, and a joint application is where you and your spouse agree to divorce.

Gather the documents – You will need the original marriage certificate or a certified copy. If you were married abroad and the marriage certificate is not in English – you will need a certified translation.

DIY or instruct someone? -Will you do a DIY divorce or will you instruct a legal professional?

Don’t forget there will be a Court fee when submitting the divorce application, or you may be eligible for help with fees if on a low income.
