Can you get a financial order without getting divorced?
To make any financial agreement legally binding, you must include the terms of the agreement into a financial order within divorce or dissolution proceedings. Those proceedings act as the “hook” upon which the financial order can be hung upon and gives the court jurisdiction to make the order.
The application for a financial order will require the case number from the divorce proceedings.
If you wish to record a financial agreement without divorcing, you can include the terms into a Separation Agreement, however, this will not be as legally binding as a court-approved financial order.
